Cloudera Faces Two-Year PERM Restriction in $2 Million Federal Recruitment Settlement

WASHINGTON, October 20, 2026 – Technology company Cloudera has agreed to a federal settlement involving up to $2 million in penalties and back pay, along with a 24-month restriction on participation in the permanent labor certification (PERM) program used for employment-based green card sponsorship. The Justice Department and Department of Labor announced the resolution October 16.

The agreement concerns allegations that Cloudera’s recruitment process prevented qualified U.S. workers from applying for certain positions associated with green card sponsorship. It could also affect future PERM sponsorship planning for employees, including foreign professionals working in the United States.

What happened in the Cloudera case?

According to federal investigators, Cloudera used a separate recruitment process for jobs connected to PERM labor certification. Rather than advertising these positions through its regular public careers website, the company directed applicants to a special email address. The problem was that the email address could not receive messages from external accounts.

As a result, applicants following the advertised instructions could not successfully submit their applications. Federal investigators identified at least one affected U.S. worker. The Justice Department filed a discrimination complaint in April 2026, alleging that Cloudera failed to give U.S. workers a genuine opportunity to compete for positions earmarked for temporary visa holders.

Cloudera has denied intentional discrimination and maintains that it complied with the law. The October settlement resolves the dispute without establishing a criminal conviction.

What are the settlement terms?

The agreement requires Cloudera to pay $600,000 in civil penalties and establish a back-pay fund of up to $1.4 million for affected U.S. workers.

Those are different obligations. Civil penalties go to the government, while the back-pay fund is intended to compensate qualifying individuals. Cloudera must also withdraw outstanding PERM applications associated with the nonfunctional recruitment email address.

Under the Department of Labor portion of the agreement, the company must refrain from filing new PERM applications or posting PERM recruitment advertisements for 24 months, beginning from the date of its most recent relevant application withdrawal.

The company also faces training, monitoring and reporting requirements.

What is PERM and why does it matter?

PERM is the labor certification process used by many U.S. employers sponsoring foreign nationals for permanent residence.

For covered positions, employers generally must test the U.S. labor market and demonstrate that qualified, available and willing U.S. workers were given a genuine opportunity to apply.

The process is particularly relevant to EB-2 and EB-3 employment-based green card cases, including those involving Indian professionals. Employers cannot use recruitment procedures that improperly discourage or exclude protected applicants.

A PERM certification is also not the same as a green card approval. It is one step in a longer immigration process.

What happens to Cloudera employees seeking green cards?

The settlement may affect employees whose cases depend on Cloudera filing new PERM applications during the restriction period. Employees with pending or planned sponsorship should seek case-specific information from their employer and qualified immigration counsel.

They should establish whether their applications are connected to the affected recruitment process and whether any withdrawal or filing restriction applies. Importantly, the settlement does not say that every Cloudera employee loses immigration status or that every previously approved immigration petition is invalid.

Existing H-1B status, approved petitions and adjustment applications involve separate legal requirements and must be evaluated individually.

What should employers learn?

The agreement highlights the importance of functional application systems and consistent recruitment practices.

Employers conducting PERM recruitment should confirm that advertised contact methods work, applications reach the appropriate staff and applicants receive fair consideration.

The settlement also requires Cloudera to align its PERM recruitment with ordinary hiring practices and submit to additional compliance oversight.
